When New York law enforcement agencies investigate accidents, some of the actions of drivers might leave them scratching their heads in wonder. For instance, a driver recently came to a stop on Interstate 90, which led to a truck vs. car accident. It could be some time before authorities are able to understand what happened. The 29-year-old driver of the car and his passenger, a 19-year-old woman, were heading westbound on the interstate. For a reason not yet ascertained, the driver came to a stop in the outside lane at approximately 7:45 p.m. An 18-wheeler heading in the same direction slammed into the car. It was not reported whether the driver of the semi truck could have avoided the collision or not.The seriously injured driver was taken to a hospital in the Little Falls area where he succumbed to his injuries despite the efforts of medical personnel. His passenger was also seriously injured. At last report, her condition was listed as critical by an Albany hospital. Troopers with the New York State Police closed the westbound lanes of the interstate between exits 29 and 29A for several hours while they conducted their investigation. The outcome of that investigation could be of interest to the critically injured passenger since an understanding of how the truck vs. car accident occurred could prove to be crucial to any personal injury claim she makes. Establishing negligence is an integral part of any such civil action, and knowing what part each driver played in the accident could help in establishing that her injuries were the result of the actions of one or both drivers. Successfully proving negligence to the court's satisfaction may result in an award of damages that could help with the unexpected medical expenses, lost wages and other damages that she probably will continue to sustain as she recovers from her injuries.
